1. Purpose
These General Terms and Conditions of Sale (the “GTC”) govern the sale and subscription of the services and products offered by Elefantia:
- via the Elefantia application (web and mobile) and the Elefantia website;
- via the Shopify store operated by Elefantia (digital activation codes and gift boxes);
- via in-app subscriptions managed by the Apple App Store and Google Play.
2. Offers and description of the services
2.1 Digital offers
Subscription term: full access to Elefantia for 6 or 12 months; unlimited chapters; adding photos; eBook in PDF format; possibility to order prints of paper books. An activation code is sent by email (immediately) or via a gift box.
Monthly subscription (/month): monthly access with no commitment, with or without automatic renewal, which may be subscribed via the App Store, Google Play or the Elefantia website. (Subscription management depends on the purchase channel.)
Certain paid services may be activated by means of an Activation Code (e.g., an offer such as “My story as books”, code sent after purchase by email or gift box).
Unless otherwise stated, the purchaser (or the gift recipient) has a maximum period of twelve (12) months from the Code Issue Date to activate the Activation Code on an Account.
At the end of this 12-month period, if the user has not activated it, the Activation Code may be automatically activated by Elefantia (or deemed activated): the subscription period and/or the associated rights then start automatically, and the right of use runs from this automatic activation.
Activation (manual or automatic) triggers the start of the planned access period.
2.2 Offers including printing
My story as books – 6 or 12 months and 1, 4 or 10 books: access for several months, PDF, printing and home delivery of 1, 4 or 10 copies (up to 500 pages). Activation code by immediate email or gift box sent by postal mail within 2–4 days. Printing/delivery lead times: approx. 2–3 weeks after sending to print.
Certain offers include consumables (e.g., Printing Rights). Unless otherwise stated, consumables remain usable for a limited period.
Printing Rights expire no later than twelve (12) months after the last day of the last active subscription linked to the Account (including a subscription activated via Activation Code), even if such rights have not been used.
Upon expiration, unused consumables are forfeited, unless mandatory law provides otherwise or a more favorable provision is set out in these GTC. Where the purchase is made via the Apple App Store or Google Play, billing, renewal management and refund requests are also governed by the rules of the relevant Store.
2.3 Gift box
Gift box: box + printed guide booklet + activation code entitling to the “My story as books” offer (Subscription + book(s)). Postal shipment.
2.4 Human support (service)
My supported story (at home – 4 to 20 hours): 12-month access, PDF, ebook or 1 to 10 printed books + in-home support anywhere in France by an “Elefanto”, 2-hour sessions, 4 to 20 hours total. Printing lead times: ~3 weeks.
My manuscript as books: PDF, ebook or 1 to 10 printed books + proofreading/editing/copyediting service: “Manuscript ready to print”, “Manuscript to proofread/correct/edit” or “Documents to digitize and structure”.
2.5 Key features reminder (extracts)
Unlimited chapters, adding photos/illustrations per chapter, application available on smartphone and computer, PDF downloadable from the personal area. Copyright in the final text belongs to the customer.
3. Ordering and activation process
3.1 Account creation & activation in the app
Create an account via the Elefantia website or via the app (iOS/Android); validate the email;
Follow the onboarding (preliminary questions, preparatory interview).
3.2 Purchase in the Store
Purchase of an Activation Code (digital or included in a gift box). Receipt:
- Email: code and instructions immediately;
- Gift box: postal shipment (indicative lead times 2–4 business days).
To activate your account, go to the activation page (see “Links” section at the end of this document), enter your login (email), your password, and the provided activation code. The offer conditions start upon activation.
3.3 In-app subscriptions
In the event of a purchase via Apple or Google:
- billing, renewal management and refund requests are handled according to the rules of the relevant store;
- cancellation is carried out in the settings of the Apple/Google account (and not via Elefantia).
4. Prices – invoicing
Displayed prices include all taxes (VAT) as of the order date. Any delivery costs (gift boxes, printed books) are specified during checkout. Payment methods supported in the store include: bank cards, Apple Pay, PayPal, Shop Pay, etc.
Elefantia reserves the right to change its pricing in the future, without affecting orders already paid for.
5. Subscriptions
Digital monthly: subscription with no commitment, with or without automatic renewal depending on the option chosen at the time of purchase.
Digital 6 months / Premium 12 months: access for the indicated duration.
Subscription management:
- In-app purchase: via Apple/Google (cancellation effective at the end of the current period).
- Purchase via Elefantia: cancellation at any time from the app (Profile tab > “Cancel/Unsubscribe”). Access remains active until the current period ends. (In accordance with your offer notices.)
6. Delivery
Activation codes: immediate email;
Gift boxes: indicative lead times 2–4 business days;
Printed books: print-on-demand, 2–3 weeks after approval;
Professionnal services: scheduling agreed with the customer (mainland France).
7. Right of withdrawal (distance purchases)
7.1 Purchases on the Elefantia online store
The consumer has a legal period of 14 days from receipt of the item (or from the email for a digital good delivered by code) to withdraw, except for statutory exceptions (see below). Physical returns follow Elefantia’s Refund Policy; return address: 6 rue d’Alet, 35400 Saint-Malo.
7.2 Common exceptions to the right of withdrawal
Digital content not supplied on a tangible medium where performance has begun with your express consent and waiver of the right of withdrawal (activation of a code and access to the service).
Personalized goods: books printed on demand based on your manuscript and your elements (photos, back cover, etc.): no withdrawal once the print order has been initiated.
“My Biographer” service started before the end of the 14-day period at your request: billed pro rata to the hours completed; refund of the balance if applicable.
7.3 In-app subscriptions
For purchases made via Apple or Google, withdrawal and refunds are governed by the stores’ policies (Elefantia cannot technically act on these payments).
8. Returns
Practical terms (prior request, return label, exclusions, refund timelines) are described in Elefantia’s Refund Policy. Reminder: personalized goods and gift cards are non-returnable.
9. Statutory warranties
Independently of any commercial warranties, Elefantia applies statutory warranties (conformity and hidden defects).
For digital content/service, Elefantia provides the necessary updates and access in accordance with the description for the duration of the subscription.
For printed goods (books, gift boxes), you benefit from the applicable statutory warranties (conformity / hidden defects), subject to normal use and the absence of non-compliant customization stemming from your own files.
10. Customer account
Creating an account requires a valid email address and a secure password. You declare that you are of legal age and have the legal capacity to contract. You are responsible for keeping your credentials confidential.
11. Intellectual property and rights in content
11.1 User content (“Inputs”)
The user remains the owner of all rights in the content that they provide or import into the Application (texts, photographs, recordings, documents or any other element) (the “Inputs”).
11.2 Content generated via the Application (“Generated Content”)
“Generated Content” means the texts, chapters, manuscript versions, rewrites, summaries, titles, formatting and, more generally, any content produced at the user’s request via the Application, based on their Inputs and/or instructions.
11.3 Assignment of rights to the user
Elefantia assigns to the user, on an exclusive basis, all economic rights that Elefantia might hold, where applicable, in the Generated Content, as and when it is created, for the entire world and for the legal term of protection, for all purposes and on all media known or unknown to date, including in particular:
(i) the right of reproduction (paper, digital, audio, video, storage, archiving),
(ii) the right of communication to the public (private or public dissemination, making available online),
(iii) the right of adaptation, modification, translation and arrangement,
(iv) the right of distribution (sale, loan, gift, self-publishing, dissemination via a third party, platforms),
(v) the right of incorporation into any work or composite medium.
This assignment is granted in consideration of the price paid by the user for access to and/or Elefantia services.
This clause constitutes an assignment of rights within the meaning of the French Intellectual Property Code.
11.4 Free disposal
The user is free to review, modify, export and use the Generated Content as they choose, in compliance with applicable laws and regulations.
11.5 Technical licence granted to Elefantia
In order to provide the service, the user grants Elefantia a non-exclusive, worldwide licence limited to the duration of use of the service, allowing Elefantia to host, store, copy, process, transform and display the Inputs and Generated Content solely to:
(i) operate the Application’s features,
(ii) enable export at the user’s request,
(iii) fulfill a printing order,
(iv) ensure maintenance, security and improvement of the service.
Elefantia does not use these contents for other purposes without the user’s separate agreement.
11.6 Printing
When the user generates a digital file or orders a print, Elefantia provides a technical and logistical intermediation service (file preparation, transmission to a printing service provider, tracking), without assuming the role of a publisher.
The user remains solely responsible for the printed content.
Elefantia may refuse to execute an order in the event of a reasonable suspicion of illegality or infringement of third-party rights.
12. Activation Codes – conditions of use
Codes are single-use and activate the corresponding offer for the planned duration from the time of activation.
Validity before activation: 24 months.
In case of loss of an unused code, please contact support (proof of purchase required).
13. Printing
Before sending to print, an electronic proof (PDF) is displayed. You are responsible for the elements provided (texts, photos, spelling, image rights). Once the printing order has been initiated, no modification or cancellation is possible (except in the case of a proven printing defect).
14. Served area – customs
Deliveries in mainland France (and areas displayed at checkout). For shipments outside the EU, duties and taxes may apply and remain payable by the customer.

In accordance with Articles L.612-1 et seq. of the French Consumer Code, the consumer has the right to use, free of charge, a consumer mediation service in order to seek an amicable resolution of the dispute with Elefantia.
After a prior written complaint to our customer service (by post to ELEFANTIA SAS – 6 rue d’Alet, 35400 Saint-Malo, or by email to contact@elefantia.com) and failing a satisfactory response within thirty (30) days, the consumer may refer the matter to the following mediator:

16. Personal data
The processing of your data is described in Elefantia’s Privacy Policy. (Access, rectification, deletion, portability; no transfer to third parties for marketing purposes; restricted access by the founders for support purposes.)

17. Limitation of liability
Elefantia shall not be liable for delays or inability to perform due to force majeure. For the digital service, liability is limited to the amounts paid over the contractual period concerned, to the extent permitted by law.
18. Evidence
Electronic records kept by Elefantia and/or its payment service providers constitute evidence of communications, orders and payments. Contracts may be archived. Contract language: French.
19. Assignment – partial invalidity – non-waiver
The invalidity of a clause does not affect the validity of the others. Failure to exercise a right does not constitute a waiver.
20. Amendment of the GTC
Elefantia may amend these GTC. The enforceable version is the one in force on the order date. Ongoing subscriptions will be informed in the event of a substantial change.
21. Governing law – competent courts
These GTC are governed by French law. In the event of a dispute, the territorially competent French courts shall have jurisdiction; the consumer may bring the matter before the court of their place of residence.
